Terms of service

Nothing in this policy limits any right or remedy a customer has under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African law.

1 Scope and acceptance

These Terms and Conditions apply to every quotation, invoice, website order and other sale by Mikdash Collective. By accepting a quotation, paying an invoice or placing an order, the customer confirms that the order details and these policies have been read and accepted.

2 Quotations and prices

• A quotation is valid for the period stated on it. If no period is stated, it remains valid for seven days.
• Prices are stated in South African rand and include VAT only where the quotation or website expressly says so.
• Delivery is not included unless it is expressly shown as a separate line item or stated as included.
• Mikdash may correct an obvious pricing or description error before accepting an order. If payment has already been made, the customer may accept the corrected order or receive a refund.

3 Orders and payment

• An order becomes binding when Mikdash confirms the order and receives cleared payment.
• Full payment is required before production begins unless different payment terms are confirmed in writing.
• Production will not begin until the customer has approved all required details, including product, size, fabric, colour, piping and other selected options.
• Ownership remains with Mikdash until full payment has cleared. Risk passes as set out in the Shipping and Delivery Policy.

4 Made-to-order products

A product is made to order where it is manufactured after the order is placed or incorporates a customer-selected size, fabric, colour, piping, configuration or other option. These choices form part of the approved order specification. The customer must check the quotation or order confirmation carefully. Mikdash is not responsible for an incorrect selection that appeared in the approved order, unless Mikdash supplied something different from that order.

5 Fabric colour and material variation

• Screen colours, photographs and printed samples may differ slightly from the finished fabric.
• Minor dye-lot, weave, nap, texture and grain variations are natural characteristics and are not defects.
• Where fabric direction or pattern placement affects the finished appearance, Mikdash will use reasonable production judgement unless the order records a specific instruction.
• Customers should use the Mikdash sample box or request physical samples when colour or texture is material to their decision.

6 Manufacturing lead time

The estimated manufacturing lead time is four to six weeks from the date on which cleared payment and all approvals are received. This is an estimate rather than a guaranteed completion date. Supplier delays, fabric availability, public holidays, transport disruption, load shedding and events outside reasonable control may affect the estimate. Mikdash will notify the customer of a material delay.

7 Changes and cancellation

A requested change is effective only when Mikdash confirms it in writing. A change may affect the price and lead time. Because most Mikdash furniture is made to the customer’s specifications, the ordinary seven-day cooling-off right for electronic transactions may not apply to those goods. A customer who asks to cancel before production begins should contact Mikdash immediately. Mikdash may deduct a reasonable cancellation charge and any reasonable costs already incurred, subject to applicable law. Once materials have been ordered, cut or allocated, or production has started, cancellation may not be possible except where the law provides otherwise.

8 Product use and care

The customer must follow the care instructions supplied with the product. Indoor products must not be exposed to outdoor conditions. Outdoor use is covered only where the product and fabric were expressly sold as suitable for outdoor use.

9 Liability and applicable law

Mikdash does not exclude liability that cannot lawfully be excluded, including liability arising from gross negligence or defective goods where legislation imposes liability. To the extent permitted by law, Mikdash is not responsible for indirect loss that was not reasonably foreseeable when the order was accepted. These terms are governed by the laws of the Republic of South Africa.
